To U-Haul Management and Equipment Recovery: This email constitutes formal notice, demand, and preservation notice concerning the recovery and removal of a U-Haul vehicle from the private property located at 17460 FM 744, Frost, Texas 76641, owned by Lena Collard, and concerning the personal property that remained inside the vehicle when U-Haul recovered it. U-Haul personnel or an agent acting on U-Haul's behalf entered the private property and removed the vehicle without prior notice to, or permission from, the property owner. The circumstances and authority relied upon for that entry are disputed. Regardless of any dispute concerning the rental period, late fees, charges, or U-Haul's contractual rights concerning its vehicle, personal property belonging to individuals other than U-Haul remains separate and distinct from U-Haul's ownership interest in the vehicle. FORMAL DEMAND FOR SUPERVISED ACCESS I hereby demand that U-Haul provide prompt, reasonable, supervised access to the vehicle for the sole purpose of identifying and retrieving personal belongings contained inside it. I am not requesting possession of the U-Haul vehicle, nor am I attempting to interfere with U-Haul's possession of its vehicle. I am requesting only the opportunity to retrieve personal property belonging to me. Please provide, in writing: 1. The vehicle's current physical location; 2. The date and approximate time it was recovered; 3. The identity of the U-Haul employee, recovery agent, contractor, or towing company involved; 4. The name and contact information of the person authorized to arrange supervised access; 5. A specific date and time when supervised access will be provided; and 6. Written confirmation that the personal property inside the vehicle has not been removed, discarded, damaged, concealed, transferred, or otherwise disturbed. If U-Haul refuses access to the personal property, provide that refusal in writing and identify the specific contractual provision, statutory authority, court order, or other legal basis upon which U-Haul claims the right to deny access. FORMAL PRESERVATION DEMAND U-Haul is hereby placed on formal notice to preserve all potentially relevant evidence concerning the rental, recovery, entry onto the property, removal of the vehicle, transportation of the vehicle, storage of the vehicle, and handling of its contents. This preservation demand includes, without limitation: - GPS and vehicle-location records; - dispatch records; - recovery assignments; - employee and contractor identification records; - towing/recovery records; - call logs and recordings; - text messages and internal communications; - emails and customer-service communications; - recovery notes and incident reports; - photographs and videos; - dash-camera and vehicle-camera footage; - surveillance/security-camera footage; - facility entry and exit records; - gate/access records; - timestamps and electronic access records; - vehicle inspection records; - inventory records; - records concerning property found inside the vehicle; - records concerning the decision to recover the vehicle; - communications concerning entry onto 17460 FM 744; - communications concerning the personal property inside the vehicle; and - any other electronically stored information or physical records relating to these events. You are specifically instructed to preserve information that may otherwise be automatically deleted, overwritten, recycled, or purged pursuant to routine retention policies. Do not alter, delete, destroy, overwrite, conceal, discard, transfer, or otherwise dispose of potentially relevant evidence. NO WAIVER Nothing in this correspondence constitutes an admission that any amount claimed by U-Haul is owed, nor does this correspondence waive any rights, claims, defenses, or remedies concerning the rental, recovery of the vehicle, entry onto private property, or treatment of personal property. This demand is made without prejudice and with all rights expressly reserved. Please treat this correspondence as a formal notice that the circumstances surrounding the entry onto the private property, removal of the vehicle, and continued denial of access to personal property are disputed. I expect a written response promptly, including the vehicle's current location and arrangements for supervised retrieval of the personal property. If U-Haul contends that it has a legal basis to deny access, I expect that basis to be identified in writing rather than communicated verbally. Please preserve this correspondence and provide it to the appropriate U-Haul management, legal, risk-management, and equipment-recovery personnel.
